big Mitzvah / little Mitzvah

Everybody is familiar with the Mitzva Gedola. 
(The big Mitzvah) Some haven't heard of the little Mitzvah.

The Mishna Verurah (104sk 9) writes :

"People consider Pesicha  for אבינו מלכינו as a little Mitzvah."


(“שהעולם חושבים זה קצת מצוה “)

Be happy -Be Strong

REASON FOR GIVING ALIYA TO בעל תוקע

The Levush (O.Ch.584 : 2 ) writes "A person who gets an Aliyah is happy.
Pikudei Hashem Yeshorim  Mesamchei Leiv.
A happy Ba'al Tokeah has more strength and will be able to blow the 


Shofar properly without  any interruptions or mistakes."

In most  Ashkenaz Machzorim, on top of the words of  
ותשובה ותפילה וצדקה there appears  the words צום קול ממון 
Many, assume it explains the words- תשובה תפילה צדקה .

What is the connection of Tzom to Teshuvah & Kol to Tefillah?

The Rambam Hl. Teshuva enumerates all the ingredients for
Teshuva ,(Azivas Hachet, Charata, Vidui and Kabala Al Ha'asid)
 but no mention of fasting.
The Gemoro says that those who think you need Kol for
Tefillah are from the small believers. Wouldn't Kavanah
be more appropriate for Tefillah?
Why is it important to tell you Tzedakah is money ?

Perhaps, "Tzom, Kol, Mammon"  has no connection 
to "Teshuva, Tefillah Utzedokoh", but is a different formula
for a different occasion.
     
Mavirin Roa Hagezeirah can be interpreted two ways.
1) Prevents bad Gezeiros from ch”v reaching us.
2) Removes (rids) bad Gezeiros that ch”v reached us already  .

To prevent bad Gezeiros  from coming, the formula is
Teshuva, Tefilla, and Tzedaka.

To get rid of bad Gezeiros that has ch”v arrived,
then the formula is as mentioned in
The Rambam in Hl.Taniyos .

   There is a mitzvah d’Rabanan to fast.

to Hashem.

  (ג' הל' ד'- הל' ח') ונועלין את החניות- ממעטין במשא ומתן
You close the shops- reduce business dealings.

(Mammon is not Tzedokoh but loss of monetary income)

It's possible that during the Holocaust years it would
have been appropriate to say Tzom Kol Mammon,Ma'avirin
es Roa Hagezeirah  instead of UTeshuva UTefilah

The Rema (O.Ch. 123:6) writes, 
The Chazan at the end of חזרת הש"ץ
does not say .
The Mishna V'rurah says the reason
is because he relies on the תתקבל
of the Kaddish, he will be saying 
after ובא לציון.
(not to be repetitive)  
The M.V. also quotes the של"ה and
the גאון who argue and hold he should
say it.
The Minhag is to say it quietly, not to
offend the Psak of the Rema.

*Possibly the same reasoning would
apply during Selichos at Shma Koleinu.
Since the Chazzan ends the Selichos
with the Kaddish w תתקבל.

In Selichos 
we said "אשמנו מכל עם
We are the guiltiest of all nations."

Is this really true?
Worse than the Nazis etc. ?

It is true, We are on a much higher 
level and Hashem expects from
Klall Yisroel more than from the Goyim.

But even with all our faults and sins
we can't be worse than all the 
nations of the world.

Honey , Its A Date

                        Teitelbaums are the best

In the times of the Chasam Sofer, Chasidus in Hungary  wasn’t  as popular as in the Ukraine and Poland.
 When Chasidus  started to infiltrate Hungarian communities the Chasam Sofer  was not too supportive of it .
 He wrote “ Chodosh Assur min Hatora בין לאיסור (Chasidim)  bein בין להיתר (L’havdil reform)

One of the first and foremost Chasidic Rebbes  in Hungary
was the Yismach Moshe (R. Moishe Teitelbaum Zt"l , Rov in Uhel Hungary-great grandfather of R. Yoilish Teitelbaum Zt"l the Satmarer rebbe )
The Chasam Sofer had many arguments (regarding chasidus) with the Yismach Moshe some, are printed In the Teshuvos.
One of  the arguments the Chasam Sofer had with the Yismach Moshe was about kabbala being  introduced to the masses.

Chasidim   adopted Kabbala for the masses, and the Chasam Sofer argued and  held that Kabbala is not for the masses.

The Chasam Sofer felt that the Yismach Moishe  had accused him of overstepping the line
in criticizing  Chasidim.

The Chasam Sofer sent him a letter of apology, informing him  that he didn’t say what the Yismach Moshe thought he said, therefore the Yismach Moshe owes him a brocho. (Choshed Biksheirim) The Chasam Sofer concludes that he still disagrees with him.

The Chasam Sofer was trying to appease the Yismach Moshe  by asking him the following question.
How  do chazal know that Dvash of the Shivas Haminim are dates.

He answered, that  by  Bikurim it says מראשית (the first and also the best)   Chazal knew the sweetest and best honey (nectar) comes from dates.  Teitelbaum  is a
Date tree . (Tshuvas Chasam Sofer Orach Chaim #197)

Why A Date ? -Parshas Hashavua -Parshas Ki Savo

  PARSHAS HASHAVUA

  ולקחת מראשית : אין מביאין ביכורים אלא משבעת המינים (מנחות פ"ד ב')

The pasuk in Parshas ויקרא * says “כי כל שאור וכל דבש לא תקטירו” 
Rashi explains, the translation of  "דבש"  is sweets (nectar) 
derived  from any   fruit (כל מתיקת פרי קרוי דבש)

How did Chazal know that one of the Shivas Haminim   are dates ,  
If  sweets derived from any fruit,  is called דבש maybe it is an apple 
or some other fruit?

דינא דמלכותא במדינת ישראל

Bava Kama 113a

 והאמר שמואל דינא דמלכותא דינא    

There is a Machlokes Rishonim if Dina D'malchusa is 
applicable in a Jewish Malchus.
According to the רמב"ם & רשב"ם D.D. is applicable
even in Eretz Yisroel with a Jewish Government.

According to the ר"ן the land belongs to the Shevatim
and all of Bnei Yisroel, therefore the Malchus has no power 
of Dina D'malchusa.



b) Laws that the populace  accepted amongst themselves 
and are willing to pay taxes because it benefits the inhabitants 
even the ר"ן will agree D.D. applies in a Jewish Malchus."

Today with the State of Israel whose government is non-Frum,
according to,

a) Harav E. Henkin & Harav Ovadya Yosef zt"l, all the laws 
(not opposing Torah) must be followed because of D.D.

b) Harav Y.S. Elyashiv zt"l, held it is a Safek*

c) The Chazon Ish  holds  there is no D.D. in 
Medinas Yisroel.

Most Poskim would probably agree,
1) D.D. is applicable on traffic laws and building codes etc.
2) Those who benefit from the social programs may not
cheat on their taxes.

*The אבני מילואים אבהע"ז כ"ח & חת"ס יו"ד ב' שי"ד
both argue on the בית שמואל כ"ח:ג  and hold
D.D. is דאורייתא , therefore might be a
ספק דאורייתא

What happened to the צדיק?

*Last week in Parshas Shoftim it says ומי האיש הירא ורך הלבב
Chazal Darshan he is fearful of the עבירות in his hand.
Even for minor עבירות, one gets sent home. The ones who
go to war don't have any עבירות. Only true צדיקים can
go out to the battlefield.

So how is it possible for this same צדיק to come home a 
week later (Parsha) with a  יפת תואר?

Reb Sholom Schwadron zt"l answered this question with a one
liner
 "כאן קודם צבא, כאן אחר צבא"

Wrong answer please try again

Many of you, answered, that "Chazal added
an issur even when the profit is greater than the
value of the tree because of Sakana."

This answer is totally incorrect.

There is no such Chazal. On the contrary, Chazal (Bava Kama 91-92)
said you may cut down a fruit tree if the profit is greater
than the tree. The Rosh adds even if it is not more profitable
but  the space is needed.
The Taz a few lines later writes that he himself was
Matir to cut down a fruit tree so they can build a house in its place.

It is true that Tzavo'as R. Yehuda Hachasid forbids cutting
down the tree even in such a case because of Sakanah but that is not

Chazal Assering.

ואתו לא תכרת (דברים כ:י"ט)


The Taz (Y.D. 116: 6) writes,

שאסרו חז"ל מפני הסכנה שלא לקוץ"
אילן העושה פירות"

"Chazal forbade because of סכנה
 to cut down fruit trees" 

Isn't it the Torah who forbade 
cutting down fruit trees?

Reb Moishe By A Chalitza

Before the Chalitza shoe is put on
the Yavam, they wash his foot and dry it.
This is done so to make sure there is no 
Chatziza between the foot and the shoe
(E.H. 169:37)

Mori V’rabi Harav Hagaon R.S.Miller Shlita 
said, he had attended a Chalitza where 
R.Moishe Feinstein zt”l. was the Mesader.

It was a fascinating scene to watch  
R. Moishe the Poisek Hador bent over with 
a washcloth and a bowl of water

washing & drying the foot of the Yavam.

At a Chalitza  ceremony I had once  attended, the
Rosh Bais Din (head of the 5* Rabonim)
said to the Yavam he had a ball and wanted to practice 
playing soccer (football) with him**.

It was very odd watching a Rav with a long beard
wearing a hat and a long kaftan, playing goalie and 
then switch with the Yavam and play offense.

After 5 minutes of playing, all Rabonim agreed
the need to repeat the Chalitza twice. Once on the 
right foot and a second time  on the left foot.

They observed the Yavam used mostly his left
foot to kick the ball.

There is a Machlokes ( Shulchan Aruch E.H. 169: 24) 
if the Yavam who is left footed can do Chalitza altogether. 

The Rema Paskens they can do Chalitza but it needs to 
be done on both feet. 

*Chalitza requires a Bais Din of 3+2
** I think he had no idea why he was asked to play


It's not OK.

According to Mori V'rabi Harav Hagaon R. Shlomo Miller Shlita,
A babysitter should be paid within the first day or night. Even
if the babysitter says it's OK to wait with payment, it might not be
בלב שלום and you might be Oiver (transgress) 5 Lavin & 1 Aseih*.

Lulav And Etrog

Whats First Getting Married Or Building A House

 - מי האיש אשר בנה בית חדש
                  ת"ר אשר בנה, אשר נטע ,אשר ארש ,לימדה
תורה ד"א שיבנה אדם בית ויטע כרם ואח"כ ישא אשה               
  (Sotah 44a)
When going to war the above questions were asked in this order, to teach us priorities in life  Build a house first ,plant a vineyard and then get married.

The Satmar Rebbe zt”l (Vayoel Moshe, Lashon Hakodesh 2) says that this Chazal refers to a second marriage. For the first marriage,  marriage comes first, even before Parnasah and housing.
His proof is, The minimum age to serve in the army was 20 years. A person who
at age 20, isn’t married is a Choteh (sinner) and wasn’t eligible to go to war.

For a 20-year-old, who never got married, these questions would not be applicable,
The Pasuk must be referring to someone who was married once before 

at age 18 and is up to his second marriage.

they all have a food that should be
roasted & eaten with mustard. It is a
Befeirushe Halacha in Shulchan Aruch.

The מסורה we have today is from none other but 
              a משומד ( convert/apostate)

                What is the מסורה ?

The מסורה started in the times of Ezra Hasofer* 
& The Anshei Knesess Hagedolah. This 
continued for over a thousand years to the times 
of the Rabonon Saveroi and early Gaonim.


There are many parts to the  מסורה.

Some parts of the מסורה  ,(there are more) 

1) How many letters and words in each Sefer (Tanach)
2) The טעמים (known as the Trop) 
3) The קרי & כתיב 
4) Nekudos (How to pronounce)
5) Begin & end Pesukim & Parshios
6) How many times the word with the same 
spelling appears.
7)  חסירות ויתירות (spelling)
8) Large & small letters
9) Similar words elsewhere in Tanach
10) When it's the name of Hashem and when not

Because of the מסורה, we have a uniform text
of the Tanach, which both the Perushim & 
Tzedokim agree on.


Yakov ben Chaim and Eliyahu Bachur were both employed 
as editors in the printing house of Danielle Bombergini. 
( The Goy who printed the first complete Shas)

Yakov ben Chaim edited the Seforim Bomberg printed.
Among them were the Shas Bavli & Yerushalmi
and the Mikraos Gedolos Chumash. 

Yakov wrote an important and  fabulous 
Hakdama** for the Mikraos Gedolos Chumash.
He also compiled and organized the Mesorah (Tanach)
which was completely disorganized and very
difficult to read.

It is fascinating, his friend Eliyahu Bachur praises 
his work and curses him in the same sentence.

Eliyahu Bachur writes " I have never seen in any of the previous 
Seforim such perfect, beautiful and organized work as was
done  by the person whose name used to be 
"Yakov תהי נשמתו צרורה ***בצרור נקוב "

Yakov convinced Danielle Bombergini to allow him to print his
Mesorah in the Chumash. 

Hence the only Mesorah we have today is from 
the Meshumad Yakov who compiled, organized
and had it printed.


*They were called Sofrim because the counted the 
letters, words, Pesukim and Parshios.(Ms.Kidushin)

** The original Chumashim had his name printed.
In the later  prints, the name was removed and 
replaced as הקדמת המעתיק

Only one month in the year,should you refrain from doing it.

Tircha Dtzibura

Amongst the many Gedolim whose Minhag
was not to say לדוד ה' אורי from R. Chodesh
  Ellul till Simchas Torah, was the Vilna Gaon.

The Aderes* writes the reason for not
saying it, was because of Tircha Detzibura.

Saying one Kapitel Tehillim takes up too
much time from the Tzibbur.

Perhaps we can explain the Aderes /Gaon,

There is no mention in Bavli, Yerushalmi,
Rishonim, Tur & Shulchan Aruch etc. to say
Ledovid Hashem (in Ellul)

The first to mention to say it Betzibbur** is
the Sefer Chemdas Hayomim*** & the Sefer
Shem Tov Katan which are Sifrei  Kabbala****.

The Gaon in general was against adding
additional Tefillos. He tried to stick to
   the original Tefillos from the Anshei
Knesses Hagedola.

A Shliach Tzibbur who starts one minute
late in a Minyan of 100 people, wasted
not one minute but100 minutes. (Tircha
of 100 people times 1 minute)

Adding a Kapitel Tehillim which takes
to say only one minute can at times
be considered taking 100 minutes.
This might explain why the Gaon
considered it Tircha Detzibura and 
didn't add it to the Tefilos during Ellul etc.

Sunday א' אלול most Shuls will be
saying 3 Kapitlach Tehillim at end
of Davening.
1) לדוד מזמור (שיר של יום)
2) לדוד ה' אורי
3) ברכי נפשי 

According to the Gaon all you
   would say is ברכי נפשי





    *הרב אליהו דןד רבינוביץ תאומים
(he was a twin)

**The Sefer Shem Tov Katan
printed before the Chemdas Hayomim
mentions only to say it ביחיד .

***major  contoversey who the
author was.Some don't say
Ledovid Hashem Ori
claiming the source
is Nasan Ha'azasi yms.

**** I believe the first Halacha Sefer

to say it is the Mateh Efraim
