יום השנה כ"ד טבת
There is a huge Machlokes
Rishonim* & Achronim**
how reliable טביעות עינא דקלא
is. Is it only when it is
מסיח לפי תומו or עדים can
testify when
they heard his voice
but never saw him in person ?
if yes is it for דיני ממונות
only, for איסור והיתר only,or
even for דיני נפשות.
The Chasam Sofer (Shu"t
Ch.M.:2)
holds the only time we rely
on טביעות עינא דקלא is
for spouses to live together
at night
The reason for it is because in an addition
to ט"ע דקלא there
is also ידיעת הגופים
(knowledge of the spouses
body )
In all other cases we cannot
rely on ט"ע דקלא
because it is possible to imitate his voice
Perhaps with this Chasam
Sofer we can understand
how we rely on ט"ע דקלא
when two brothers can have
same voice or someone
can imitate the voice,
We only rely where we have a
combination of both
