Answer To the Parshas Mishpatim Riddle

Parshas Hashavua
ובשר בשדה טרפה לא תאכלו
                                                               
     RIDDLE

A nail pierced through the stomach of the cow. The Rav Paskened half the animal is טרפה & the other half is כשר.





The Pischei Teshuva (Y.D. 110 sk4) brings
a story that actually happened.


A  butcherSchechted 7 cows. All seemed to
be kosher. He sent 2 ½ cows to the shop
(Yatkeh) and the rest he kept at home. After
the 2 ½  cows were sent away (פרוש) he
discovered one stomach(unknown from which cow)
was pierced (Treifah)


Since 6 out of 7 animals are kosher we should
assume on each piece of meat that it comes
from the majority (kosher)


But there are two important rules in רוב.
1) At the place where ספק originated,  we don’t
follow רוב.
2) If the object left the original place, we do follow  רוב.

The two whole cows at theYatkeh being they left
the house where the ספק originated (פרוש)
we follow רוב
(6 out 7 are kosher)  therefore they are kosher.


The four whole cows at home (קבוע) we don’t follow  רוב and are all Treifah.


The two Halves, we have a three-way מחלוקת if both are kosher or both are Treifah and the
Pri Chadash who holds, the half at home (קבוע) is Treifah and the half at the Yatkeh (פרוש) is kosher.
